Personal data protection policy

This is a courtesy translation. The Spanish version is the legally binding text under Colombian law. Read the Spanish version.

1. Data controller

This policy is adopted in compliance with Colombian Law 1581 of 2012, Decree 1377 of 2013 (compiled in Single Regulatory Decree 1074 of 2015) and any rules that amend or supplement them.

3. Data we collect

Through this website we only collect the data you enter in the contact, quote request or demo request forms:

  • Name.
  • Email address.
  • Phone, company, job title and city, when you choose to provide them.
  • Your message or the description of your needs.
  • The page from which you sent the form and, if you arrived through a campaign, the campaign reference.

We do not request sensitive data or data from children or adolescents through this website.

4. Purposes

Your data is processed to:

  • Answer your request for information, advice, a quote or a demo.
  • Contact you by email, phone or WhatsApp regarding your request.
  • Record and manage the business relationship in our customer management system.
  • Send you information about related products and services, when you have authorized it. You can ask us to stop at any time.
  • Comply with legal obligations and requests from competent authorities.

5. Your rights

As the data subject you have the right to:

  • Know, update and correct your personal data.
  • Request proof of the authorization you granted.
  • Be informed, upon request, of how your data has been used.
  • File complaints with the Superintendence of Industry and Commerce (SIC) for violations of the law.
  • Revoke your authorization and request deletion of your data when there is no legal or contractual duty to keep it.
  • Access your personal data free of charge.

6. How to exercise your rights

Send your request to info@tmcingenieros.com stating your name, how we should reply and your specific request.

  • Inquiries: answered within a maximum of ten (10) business days from receipt. If that is not possible, we will tell you why and give you a new date, no more than five (5) additional business days later.
  • Claims: handled within a maximum of fifteen (15) business days from the day after receipt. If that is not possible, we will tell you why and give you a new date, no more than eight (8) additional business days later.

7. Processors and data transmission

To provide the service, data may be processed by providers acting on behalf of TMC INGENIEROS SAS, such as the website hosting provider, the email service and the customer management platform. These providers may only use the data for the purposes described here.

If you accept analytics cookies, the website uses Google analytics tools. The information you type in our forms is never sent to those tools.

8. Security

We apply reasonable technical and administrative measures to protect data against loss, unauthorized access or use, including encrypted connections, role-based access control and audit logs.

9. Validity

This policy is effective from its publication. Data will be kept for as long as needed for the purposes described or while there is a legal obligation to keep it. Any substantial change will be published on this same page.
